GENERAL TERMS & CONDITIONS

1. Scope
The following terms and conditions apply to all orders made through our online shop. Our online shop is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes which are largely unrelated to his commercial or self-employed professional activity. Entrepreneur is a natural or legal person or a legal partnership which, when concluding a legal transaction, is acting in the exercise of its commercial or self-employed professional activity.

 
2. Contract partner, conclusion of contract, correction possibilities
The purchase contract is concluded with SGMH GbR.
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can first place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the order process. The contract is concluded by clicking on the order button to accept the offer for the goods contained in the shopping cart. Immediately after submitting the order, you will receive a confirmation by e-mail.

 
3. Contract language, contract text storage
Language (s) available for the conclusion of the contract: German, English
We store the contract text and send you the order data and our general terms and conditions in text form. You can view the contract text in our customer login.

 
4. Delivery conditions
In addition to the indicated product prices, shipping costs are added. You can find out more about the amount of the shipping costs in the offers.
We only deliver by way of dispatch. A self-picking of the goods is unfortunately not possible.
We don’t deliver to packing stations.

 
5. Payment
The following payment methods are available in our shop:
Credit card When you place your order, you enter your credit card details. Once you have been legitimated as a legitimate cardholder, the payment transaction will be carried out automatically and your card will be charged.

 
Klarna
PayNow credit card When you place your order, you enter your credit card details. Once you have been legitimized as the legitimate cardholder, the payment transaction will be automatically carried out and your card will be charged immediately after dispatch of the goods.

PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. To be able to pay the invoice amount via PayPal, you must be registered there or register first, legitimize it with your access data and confirm the payment order to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. The payment transaction is automatically carried out by PayPal immediately afterwards. You will receive further information during the ordering process.

Giropay
After submitting the order, you will be redirected to the website of your bank. In order to be able to pay the invoice amount via Giropay, you must have a bank account that is activated for online banking, you must legitimize yourself accordingly and confirm the payment order to us. You will receive further information during the ordering process. The payment transaction will be carried out immediately afterwards and your account will be debited.

6. Transport damage
If goods are delivered with obvious transport damage, please report such errors to the carrier immediately and contact us immediately. Failure to make a complaint or contact has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

 
7. Warranty and Warranties
Unless expressly agreed otherwise below, the statutory right to liability for defects shall apply. In the case of second-hand goods: if the defect occurs after the expiration of one year from the delivery of the goods, the defect claims are excluded.

Defects that occur within one year of delivery of the goods may be asserted within the statutory limitation period of two years from delivery of the goods. The above limitations and shortened periods do not apply to claims arising from damages caused by us, our legal representatives or vicarious agents:
 
• in the event of injury to life, body or health

• in the event of wilful or grossly negligent breach of duty and malicious intent
 
• in the event of a breach of essential contractual obligations, the fulfilment of which enables the proper execution of the contract in the first place and on which the contracting party may regularly rely (cardinal obligations)

• as part of a guarantee, if agreed or
 
• to the extent that the scope of application of the Product Liability Act is open.

8. Liability
For claims arising from damage caused by us, our legal representatives or vicarious agents, we are always liable without limitation:

 
• in the event of injury to life, body or health
 
• in the event of intentional or grossly negligent breach of duty
 
• in the event of warranty promises, if agreed, or
 
• in the event that the scope of the Product Liability Act is open.
 
In the event of breach of essential contractual obligations, the fulfilment of which enables the proper execution of the contract in the first place and on which the contractual partner may regularly rely (cardinal obligations) due to slight negligence on the part of us, our legal representatives or vicarious agents, the liability shall be limited to the damage foreseeable at the time of conclusion of the contract, with which must typically be expected to arise.
Claims for compensation for damages are excluded.

9. Settlement of disputes
The European Commission provides an online dispute resolution (ODR) platform, which you can find here. We are not obliged or willing to participate in a dispute resolution procedure before a consumer arbitration body.
